Right of Withdrawal
If you have contracted one of our services as an individual consumer and remotely (by phone, WhatsApp or this website's form), you have the right to withdraw from the contract within 14 calendar days. Here's how it works.
1. What is the right of withdrawal?
If you contract our services as an individual consumer (not as a community of owners or a business) and the contract is made remotely — by phone, through this website's form or by WhatsApp, without a signature in person — Spanish consumer law (Real Decreto Legislativo 1/2007) grants you the right to withdraw from the contract within 14 calendar days of its conclusion, with no need to justify the reason.
2. How to exercise this right
You can let us know your decision to withdraw in any form that leaves a written record, for example:
- By email to info@piscinasdemartinez.es, stating your name, the date the contract was made and the service contracted.
- By WhatsApp or by calling 678 42 95 02, confirming it afterwards in writing.
There is no need to use a specific form, although you can use this sample template if you prefer:
"I hereby give notice that I am withdrawing from my contract for the provision of the ______________ service, contracted on ______, with Piscinas D'Martinez.
Consumer's name and surname: ______________
Facility address: ______________
Signature (only if submitted on paper) and date."
3. Exceptions and particularities of pool maintenance
As this is a continuous-performance service (periodic maintenance visits), please bear the following in mind:
- If you expressly request that the service begin before the 14-day period ends, and you acknowledge that by doing so you lose your right of withdrawal once the service has been fully performed, that right is extinguished at that point.
- If the service has already been partially performed when you exercise your right of withdrawal, you must pay the proportional part of the service already provided up to the moment you notify us of your decision.
- This right does not apply to contracts signed in person at our premises or at the client's home following a visit arranged beforehand by the consumer themselves, nor to contracting by communities of owners or businesses, which are not considered consumers for these purposes.
4. Consequences of withdrawal
If you withdraw within the period and no service has been provided yet, you will not be charged anything. If a charge has already been made, we will refund it without undue delay and, in any case, within a maximum of 14 calendar days from when we are informed of the decision to withdraw.
