Privacy Policy
Last updated: October 2026. At Piscinas D'Martinez we take the privacy of your data seriously. This policy explains what information we collect, for what purpose, for how long, and what rights you have regarding it, in accordance with the General Data Protection Regulation (GDPR) and Organic Law 3/2018 (LOPDGDD).

2. What data do we collect?
Through this website's contact form we may collect the following data, always provided voluntarily by the user:
- First and last name
- Contact phone number
- Municipality
- Service requested and, where applicable, message or additional details about the pool
The form also uses Google reCAPTCHA to prevent automated submissions (spam), which may process technical device data in accordance with Google's privacy policy.
If you use the “Ask the technician” chat, we also process the messages you write in it and the photos you send (before sending, they are shrunk on your device and their location is removed) so we can answer you. If you give permission with one tap, the chat also takes into account the technical details of your “My pool” record (shape, size, treatment type, filter, use and municipality; never the name you gave it); you can withdraw that permission at any time from the chat itself. We do not ask for personal data in the chat and we recommend that you do not include any, including in photos; if you would like us to help you personally, the chat itself offers you the option of writing to us on WhatsApp.
3. For what purpose do we process your data?
- To handle and respond to your quote request or query.
- To contact you by phone or WhatsApp in relation to that request.
- To answer the questions you ask in the “Ask the technician” chat.
- To manage, where applicable, the contractual relationship arising from hiring our pool maintenance, repair or renovation services.
We do not use your contact data to send you commercial communications unless you have given us your express consent to do so.
4. What is the legal basis for the processing?
The legal basis is the consent of the data subject, granted by voluntarily submitting the contact form, and, where applicable, the performance of a contract or precontractual measures requested by the user themselves (drawing up and following up on a quote). In the “Ask the technician” chat, the legal basis is your consent, which you give by voluntarily writing in it.
5. For how long do we keep your data?
We keep the data for as long as there is a mutual interest in maintaining the purpose of the processing (for example, for as long as the contracted maintenance relationship lasts) and, subsequently, for the legal limitation periods for liability that may apply. If you do not end up contracting any service, we keep your inquiry for a reasonable time so we can attend to it, and for a maximum of 12 months from the last contact. Conversations and photos in the “Ask the technician” chat are not stored on our server: they are deleted when you close the browser tab. Your “My pool” record is stored only on your device. We only keep usage counters (number of messages and a temporary per-connection counter to prevent abuse).
6. Who will your data be shared with?
We do not transfer your data to third parties except where legally required. We do use the following providers, who act as data processors or who receive certain technical data for the site to function:
- Google reCAPTCHA (Google LLC): anti-spam protection for the contact form. It only loads when you start filling it in.
- Open-Meteo: when you check the weather forecast on the home page or in "My pool", your browser requests it directly from Open-Meteo for the chosen town. Like any web server, it receives your connection's IP address; we send it no other data.
- WhatsApp (Meta Platforms, Inc.): if you choose to contact us through the WhatsApp button, the conversation is handled within that platform, subject to its own privacy policy.
- Hosting provider: OVH, which hosts the files and, where applicable, the website's database. The typefaces are also served from our own server, without connecting to third parties.
- Anthropic (Anthropic, PBC): an artificial intelligence provider that we use for two purposes. (1) Protecting the website: once a day it reviews attack attempts and only receives technical data about them (the truncated source network, never the full IP address, the web address that was requested and the type of browser or program used). (2) The “Ask the technician” chat: if you choose to use it, it receives the messages you write, the photos you send and, if you allow it, the technical details of your “My pool” record, so it can answer you. It does not receive any contact form data or data about our customers.
Some of these providers may be located outside the European Economic Area; in those cases, they have adequate safeguards in place (such as the European Commission's Standard Contractual Clauses) for the international transfer of data.
7. What are your rights?
Anyone has the right to obtain confirmation as to whether Piscinas D'Martinez is processing personal data concerning them. Data subjects have the right to:
- Access their personal data.
- Rectify inaccurate or incomplete data.
- Request erasure of their data when, among other reasons, it is no longer necessary for the purposes for which it was collected.
- Request restriction of the processing of their data.
- Object to the processing of their data.
- Request the portability of their data.
You can exercise these rights by writing to info@piscinasdemartinez.es, stating the right you wish to exercise and attaching a copy of a document proving your identity. If you believe your rights have not been properly addressed, you have the right to file a complaint with the Spanish Data Protection Agency (AEPD).
8. Security measures
We have adopted the technical and organizational measures necessary to guarantee the security of personal data and to prevent its alteration, loss, unauthorized processing or access, taking into account the state of technology, the nature of the data stored and the risks to which it is exposed.
In particular, when a connection makes attack attempts or too many failed login attempts, the website blocks it temporarily and logs its IP address, the date, the reason and the address requested. This log is kept for 30 days, based on our legitimate interest in protecting the website and the data it holds (art. 6.1.f GDPR). In addition, an automated system regularly checks that the website's files have not been altered, and an artificial intelligence tool reviews attack attempts daily in order to temporarily block the networks they come from, on the same legal basis and without taking any decision that affects users beyond that temporary block.
9. Cookies
This website uses its own and third-party cookies. You can review all the details, as well as configure or withdraw your consent at any time, in our Cookie Policy.
Some tools save what you enter in your own browser (local storage): your "My pool" record and its tasks, the health report history, the town chosen for the weather and your cookie preferences. This data is not sent to our servers and you can delete it from the tool itself or from your browser settings.
10. Changes to this policy
We may update this Privacy Policy to adapt it to legislative developments or changes in the services offered through the website. The date of the last update appears at the top of this page.
